Notice of Privacy Practices

This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.

Who this notice covers

This notice applies to Mito Fit Health Telemedicine Clinic and its clinical records. For privacy questions or requests, contact Daniel G. Ostermayer, MD, at (713) 496-2670, hello@mitofithealth.com, or 3120 Southwest Fwy Ste 101 #800412, Houston, TX 77098. Use our secure patient portal for medical details. Effective October 6, 2026.

Get a copy of your records

You may ask to inspect or receive an electronic or paper copy of your medical record. We respond within the deadline that applies to your request; Texas requests generally require action within 15 business days after a proper written request. We may charge a lawful, reasonable fee. If access is denied, we explain the reason and any review rights. Contact the practice or use the secure portal to request records.

Ask for a correction

You may ask in writing to correct information you believe is wrong or incomplete and explain why. If we deny an amendment, we provide a written explanation within 60 days, subject to a permitted extension, and explain how to submit a statement of disagreement.

Choose how we contact you

You may ask for a different contact method or address. We accept reasonable requests for confidential communications. You may request a paper copy of this notice even if you accepted it electronically. You may authorize a personal representative to act for you; we verify that person's authority.

Request limits and a disclosure history

You may ask us to limit use or sharing of your information. We may decline some requests. If you pay in full out of pocket and ask us not to share information about that service with your health plan for payment or operations, we honor the request unless disclosure is required by law. You may request an accounting of certain disclosures during the preceding six years. It excludes treatment, payment, operations and other disclosures exempted by law. One accounting in 12 months is free; we explain any charge for additional requests.

Treatment, payment and running the practice

We use and share information as permitted for your care, payment and practice operations. For example, we may coordinate with your pharmacy or laboratory, maintain your medical record, collect payment, review care quality or respond to your questions. The practice is self-pay and does not routinely bill insurers for clinic services. Service providers handling health information for us must meet applicable contractual and privacy requirements. We share only the information required for the permitted purpose, except where the law allows otherwise.

Family, friends and other choices

Tell us whether we may share relevant information with people involved in your care or payment. If you cannot express a preference, we may use professional judgment to share information in your best interest, for disaster relief, or to reduce a serious and imminent threat, as allowed by law. We do not sell your health information or use it for unrelated marketing. Most uses of psychotherapy notes and uses not described here require your written authorization. You may revoke an authorization in writing, except for actions already taken in reliance on it.

Other uses allowed or required by law

Subject to legal safeguards, we may share information for public health and safety, medicine recalls or adverse reactions, reporting abuse or neglect, health oversight, approved research, workers' compensation, organ donation, medical examiners or funeral directors, certain government functions, or legally valid law-enforcement or court requests. We disclose information when required by law, including to HHS to assess compliance. A request alone does not automatically authorize disclosure. We follow stricter Texas and federal protections, including additional consent or confidentiality rules for mental health, HIV-related and other specially protected records when they apply.

Substance use disorder records

If we receive substance use disorder records protected by 42 CFR Part 2, we apply those additional protections. We do not use or disclose these records in civil, criminal, administrative or legislative investigations or proceedings against you without your specific written consent or an appropriate court order and subpoena. We do not use Part 2 records for fundraising. Other permitted uses remain subject to applicable Part 2 consent and disclosure rules.

Our responsibilities

We must protect the privacy and security of your health information, follow this notice and give you access to it. We notify you of a breach when required by law. The clinic stores completed consent forms, intake answers and related requests in encrypted storage with restricted access. You can download signed copies through your private link. We send email notifications and private links, without attaching completed forms. Anyone with your link may be able to open your forms until it expires or is revoked. Protect your email account and links. Clinical communication and follow-up take place through PushHealth. Service providers may retain information under their policies and applicable agreements. Ask us for paper copies or another delivery method. We may update this notice, and the new terms may apply to information already held. The current notice is available on our website and on request.
